Important disclaimer
VA Claim Pilot is a claim preparation and organization tool. It does not provide legal advice, accredited representation, or guarantee any VA rating or claim outcome. Always review your final claim carefully and consider working with an accredited VSO, claims agent, or attorney.
1. Acceptance of Terms
By accessing or using VA Claim Pilot ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. What the Service Is
VA Claim Pilot is an informational, organizational, and claim-preparation tool designed to help users organize claim-related information, answer guided questionnaires, prepare summaries, statements, and claim packets, and better understand what information may be relevant to a VA disability claim.
The Service is intended to help users prepare and organize information. It is not a government service, law firm, medical provider, accredited claims agent, or Veterans Service Organization.
3. No Affiliation With the Department of Veterans Affairs
VA CLAIM PILOT LLC is not affiliated with, endorsed by, or sponsored by the U.S. Department of Veterans Affairs, VA.gov, or any other government agency.
References to VA forms, processes, disability conditions, diagnostic codes, or claim terminology are provided for informational and organizational purposes only.
4. Not Legal Advice, Medical Advice, or Representation
The Service does not provide legal advice, medical advice, mental health treatment, representation before the Department of Veterans Affairs, or guaranteed claim outcomes.
Use of the Service does not create an attorney-client relationship, representative relationship, fiduciary relationship, or medical provider-patient relationship.
The Service does not file claims on your behalf unless expressly stated in a future written agreement.
5. No Guarantee of Eligibility, Approval, or Rating
The Service may generate summaries, evidence checklists, personal statements, packet exports, evidence-strength indicators, or other claim-preparation materials. These are for informational and organizational use only.
We do not guarantee that a claim will be approved, that any evidence is sufficient, that any condition is service-connected, or that any particular disability rating will be assigned. All final decisions are made by the Department of Veterans Affairs or other authorized decision-makers.
6. User Responsibilities
You are responsible for providing accurate information, reviewing all outputs before relying on them, deciding whether to submit any document, and verifying all information with appropriate professionals when needed.
You agree not to rely solely on the Service for legal, medical, or benefits decisions. If you choose to file a VA claim, you remain solely responsible for the contents of your submission.
7. Accredited Representatives and Outside Help
You understand that free or paid help may be available from VA-accredited attorneys, claims agents, and Veterans Service Organizations. If you need representation or assistance with filing, review, or appeals, you should consider consulting an accredited representative.
8. Account Registration and Security
If you create an account, you agree to provide current and accurate registration information, keep your login credentials confidential, and notify us promptly of unauthorized access to your account. You are responsible for activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
9. User Content and Inputs
You may provide information such as profile information, service history, condition information, treatment history, supporting statements, medical or health-related information, and uploaded documents. You retain ownership of the information you submit.
By submitting content to the Service, you grant us a limited license to use, store, process, reproduce, format, and display that content solely for the purpose of operating, maintaining, securing, improving, and providing the Service to you.
10. Consent to Use Information
By using the Service, you consent to our collection and use of the information you provide in order to operate the Service, generate claim-preparation outputs, save your progress, provide account functionality, improve usability and product features, and communicate with you about your account or the Service.
We do not sell your personal information or the information you submit through the Service. We may use aggregated, de-identified, or anonymized information to improve the Service, analyze usage, and develop new features, provided that such information does not identify you personally.
11. Health-Related Information
The Service may allow you to enter health-related or claim-related information. You understand that you choose what information to provide, you should avoid submitting unnecessary sensitive information, and you should review our Privacy Policy for how information is handled.
12. Generated Documents and Outputs
The Service may generate claim summaries, personal statements, evidence checklists, packet exports, rendered PDFs, form-aligned exports, and other documents. These outputs are tools for convenience and preparation only. They may require editing, verification, or supplemental information before use.
You are responsible for reviewing any output before printing, saving, sharing, or submitting it.
13. Permitted Use
You may use the Service only for lawful, personal, and authorized business purposes related to claim preparation, organization, education, and review.
You may not use the Service to violate any law, impersonate another person, upload malicious code, attempt unauthorized access, interfere with the Service, scrape or reverse engineer the Service except as permitted by law, or use the Service to provide unauthorized legal or representative services to third parties.
14. Intellectual Property
The Service, including its software, design, workflows, branding, content structure, and generated templates, is owned by VA CLAIM PILOT LLC or its licensors and is protected by applicable intellectual property laws.
You may use outputs generated from your own inputs for your personal claim-preparation purposes. You may not copy, resell, redistribute, or commercially exploit the Service itself without our written permission.
15. Third-Party Services
The Service may rely on or link to third-party services, including authentication, hosting, analytics, document generation, or external websites. We are not responsible for third-party services, content, policies, or outages. Your use of third-party services may be subject to their own terms and privacy policies.
16. Service Availability
We may change, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
17. Disclaimer of Warranties
The Service is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be error-free, outputs will be complete or accurate, the Service will meet your expectations, or any claim-related result will occur.
18. Limitation of Liability
To the maximum extent permitted by law, VA CLAIM PILOT LLC, its owners, officers, employees, contractors, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, benefits, opportunity, or goodwill arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or $100.
19. Indemnification
You agree to defend, indemnify, and hold harmless VA CLAIM PILOT LLC, its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party rights.
20. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, your use creates risk to us or others, or we discontinue the Service. You may stop using the Service at any time.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute provisions.
21. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice by updating the effective date, posting notice on the website, or notifying users through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
22. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
23. Venue
Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.
24. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
